Now I have to read the damn bill. Looking at the comments it is worse then I thought. I kind of figured they would try to stop any loopholes, like making your own fuel since this isn’t about actually reducing emissions. Just a justification for further increasing the tax burden on those of us still productive.

Rachel Notley’s new carbon tax law is unconstitutional, because it, at least, violates the Charter’s sections 7, 8, 9 & 12.

To review:

“7. Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in accordance with the principles of fundamental justice.

[Allowing arbitrary searches and seizures would deviate from “fundamental justice”.]

8. Everyone has the right to be secure against unreasonable search or seizure.

[Searches and seizure without a search warrant would be unreasonable.]

9. Everyone has the right not to be arbitrarily detained or imprisoned.

[Detaining some one due to a search and/or seizure without a search warrant would be arbitrary.]

…12. Everyone has the right not to be subjected to any cruel and unusual treatment or punishment."

[Deviating from the Charter would be unusual.]

The NDP law would likely also no comply with decades of case law.

Rachel plus her NDP government would be highly-stupid to pass such a law!

Well Jeremy, I have not read it … yet. 108 pages of what usually should take about an hour will likely be a few hours for me since I despise legalize.

But the very fact that the NDP feel the need to even have legislation in the bill that specifies the enforcement of this bill and that no search or seizure requires a court order for any private property whatsoever is extremely alarming.

So long as the main stream media either keeps quiet about it or worse, cheerleadering it on, the NDP will likely get away with it.

I blame the people who voted in the NDP more than the NDP themselves. The NDP are just doing what their little lemming minds and screwed up ideology dictate they do. The people who voted in these assholes are the real bastards.

Peter – A friend of mine said he read an analysis that says that the warrant less searches only apply to business not private property. My reading revealed no such distinction. There is even a section about an officer can demand to search your vehicle without warrant. If the officer suspects you of having ‘marked’ fuel in your tank. Anyone on here use marked fuel? Does it give off a different odder or colour when burned? How would an officer make this judgement of a passing vehicle?

Gestapo, Stazi by any other name. Why are you surprised a statist socialist regime are in love with undercover police and warrantless search – police state mentality. What is more telling is they can’t and refuse to show the benefits to the climate to justify such a police state regime.

This is a bill that crosses the line. I see at least 8 charter violations in it. You could waste your time taking them to court but the simplest solution is wide spread civil disobedience to unconstitutional laws and then toss the buggers out and repeal all their fascist statutes.

A quick look through the main stream media revealed to me that they do not even address or recognize the enforcement sections of this bill. All of the main stream media either are bland in their report or are cheerleaders for this bill … of the ones that I saw.

So either the MSM is in agreement with the heavy handed (and possible unconstitutional or illegal) enforcement of this bill or they never did their due diligence and read the bill.
