“Alberta vs Alberta”: Notley government hires NDP connected BC “legal eagle” activist to sue itself

I told you about the Alberta government suing itself to overturn a regulation they claim they didn’t know about that states Alberta electricity retailers can dump their contracts if the government makes a change to policy that would render their contracts unprofitable. 

The Alberta government has done just that by bringing in a carbon tax and increasing taxes on coal fired electricity. Now, it looks likes Albertans are going to see a long drawn out legal battle between the government and Alberta’s energy retailers.

So who is the legal eagle who will be handling the interesting case of Alberta versus Alberta?

It’s a lawyer named Joseph Arvay. In Alberta we haven't heard much about him but that’s because he is from BC, like almost everyone else the NDP government hires.

Arvay is a politically connected NDP lawyer, having worked on behalf of Adrian Dix’s NDP in BC against the Northern Gateway Pipeline project. That’s another Alberta job that went to an NDP connected out of province activist rather than someone from Alberta.

Arvay has fought, and won, many high profile cases. But that’s not the point.

My concern is that Rachel Notley’s job creation strategies amount to her simply hiring NDP connected people from outside the province for jobs non-partisan Albertans can easily do.

Which is it? Did they not know about the ramifications of reneging on the contracts, or are they lying? A poor job of the latter I have to say. NDP SUCKS posted a link where during a debate Jim Prentice explicitly told Notley about the huge costs involved if an NDP government were to proceed with their FOOLISH war on coal. Her legal hire was apparently at the side of stooge Adrian Dickhead in BC. All I need to know. SICK

There was an app a while back that would extrapolate from your picture what you would look like when you are 90 years old. Looks like Rachael is pushing 80. Too bad wisdom isn’t keeping up.

This poses a very interesting legal question and I have not been able to find another example or precedent of it. You can’t just sue willy nilly…the court has to allow the lawsuit. The government DOES get sued by individuals and in class actions but you have to convince the court that there is grounds for the lawsuit. I cannot find any example on CANLII or LEXUM of a lawsuit where the plaintive and respondant were the same entity. That alone would give a judge grounds to dismiss the application for the lawsuit.

This is a matter of contract law….the most sacrosanct thing in the law IS contract and the courts have never and will never let the government off the hook for contract terms….Rachel Notley is a labour lawyer…she aught to know that….from experience.
