Back in the mid-eighties Saturday Night Magazine featured an article titled : “Who Told The Supreme Court They Could Run The Country Anyway”. It was a great question and a great article. I still have it filed away somewhere but it is definitely worth looking up and giving it a read.

It is no stretch to think that if you as a judge think you are correct that you might lean towards hiring people who agree with your “superior” logic and eventually become a club of like minded trained seals and no one can do anything about it. Allowing the public to vote keeps them painfully in touch with the unwashed masses.

In the real world Parliament is where laws are made . . . Supremes Enforce those laws.
Canada’s Supremes are sleezy . . . perhaps they should be “Elected” . . . and Accountable !

Ezra Levant does not look like a “wee man” as he questions the Supreme Court.

It is a legitimate question: Should the nine appointed members of the Supreme Court have so much power in Canada?

I think they should, and I respect the system. But I also respect the diminutive Ezra Levant’s questioning. Might they be elected? Might they be more biased toward my way of thinking?

For a persecuted minority like Ezra Levant the composition of the Supreme Court makes a lot of difference.

I also get a laugh at the media’s calling Trump a racist as he questioned whether a judge with Mexican heritage was racially motivated to insert himself into a case. I don’t put people on pedestals whether or not others want to give them God like reverence. Hopefully they are well learned and highly intelligent but they are corruptible and subject to the same bigotry as the rest of us whether they admit to it or not and sometimes they get it wrong whether it’s popular or not.

@andrew Stephenson I’m surprised at the simplistic position you have taken which assumes that judges always make fair decisions with integrity because you fail to account for countries where corrupt judges don’t have to worry about be elected and often do what is politically expedient. Even in the U.S. in the case of Dred Scott the U.S, supreme court got it wrong when they deprived Mr.Scott of his rights. The one thing about election is while it is true you might get some corrupt judges, it is also true if they become so unbearable to the public they can be voted out and they need to be aware they might be facing the wrath of their corrupt judgements at some juncture. https://en.wikipedia.org/wiki/Dred_Scott

As it stands in our system with this system there is no checks and balances for the people… Only a panel of judges that can be bought off to serve the bidding of the highest bidder..
Two very dangerous words and they are “unelected and unaccountable”
All the people of this country that are under 60 years of age will see how a communist dictatorship comes to power.

Sometimes what’s right is not what’s popular. I’d rather our judges be doing their job, which is making decisions that are fair, not which are politically expedient.

The SCOC is the only check-and-balance we actually have and it’s critically important that we maintain their integrity and independence.

It was predicted that when Sr. Trudeau first introduced the Charter that we would be handing the making of our laws over to judges of the Supreme Court. Looks like they were right. Thanks Pierre! Now your son continues the destruction of what was once a great country. We are becoming the laughing stock of the world and come January when the price of every thing you buy will be going up dramatically, unlike your pay cheque we’ll see how great a place Canada has become. Shame, shame, shame.

Railing over Kandar’s jurocracy is getting stale – those of us who warned that this would be the ultimate effect of the charter ( the charter section 1 creates a new supreme level of legislators superior to parliament and unelected/unaccountable) – the SCC was empowered as the sole arbiter of the charter by the charter and has acted to unilaterally rewrite and add to the charter with rulings which “read in” things clearly not in nore meant to be in the charter.

Its a jurocratic dictatorship – we all know this – now go out and find 10 sheeple who can stop chewing their cud long enough to give a damn.

Ezra, I appreciate your criticism of Canada’s Supreme Court and how this tyranny of activist, unelected, unaccountable judges, has transformed and is corrupting Canada’s Parliamentary System of Government. An appropriate topic on the eve of Remembrance Day, honoring and remembering the many men and women who bravely fought for our freedom.
You point out that “In Canada, judges make the law”. Of the sitting Supreme Court justices, you asked “How many can you name?” I can name one and that’s enough, Audrey McLachlin, Chief Justice of Canada, sitting front and center in the photo you showed of the members of Canada’s Supreme Court. This judicial tyranny at play in Canada is not even hidden. McLachlin agrees with your assessment, having brazenly declared, “There is little point decrying the fact judges make law; they do and they must.” Liberal Prime Minister Justin Trudeau’s first Supreme Court nominee, Malcolm Rowe who was sworn in officially Monday, as well, espouses a “judicial activism” that goes against Canada’s constitution. Rowe’s stated belief that the courts make laws rather than interpret them means that he fits in quite nicely with the current crop of activist justices headed by McLachlin. According to the Canadian parliamentary system, “The legislative branch is the law-making branch", contrary to McLachin’s imperious assertion. These justices should be required to take a basic civics class!

The Canadian democratic system is one of the better ones in the world, but it has some real issue, especially with the judges and the senate.

Both should be elected.

unelected, unaccountable, says it all, the liberals think they are gods, why are they so scared of elections, ALL JUDGES SHOULD HAVE TO FACE THE PUBLIC FOR RE ELECTION, THEY WOULD HAVE TO BE ACCOUNTABLE TO THE PUBLIC TO SOME OF THE MORE PATHETIC DECISIONS THEY MAKE. IMAGINE THAT HAVING TO EXPLAIN TO A VICTIM WHY THE CRIMINAL IS NOT IN JAIL, OR WHY THEY LET CHILD MOLESTERS OUT TO LIVE AMONG US.
