C-246: This private member’s bill “could end farming and hunting as we know it”

Bill C246 is a private member’s bill formally called the Modernizing Animal Protections Act. It being promoted as legislation against shark finning, but that’s not the whole story. 

The bill was introduced by Liberal backbencher (and vegan) Nathan Erskine-Smith. This legislation has been struck down seven times, but the Liberals are in charge now and the bill could pass.

It reads that anyone who “kills an animal or, being the owner, permits an animal to be killed, brutally or viciously, regardless of whether the animal dies immediately” is guilty of committing a criminal offence and could face a punishment of up to five years in jail and up to $10,000 in fines.

With no legal definition of what brutal or viciously means, and without any exceptions written into the law for traditional animal uses, any person causing the death of an animal is at risk for charges, including people who butcher their own chickens for meat or a driver who has hit a deer on the highway.

The Liberals are always looking for ways to criminalize our western way of life.

What Bill C-246 will NOT do:
Criminalize hunting, fishing, farming, or medical research on animals, as long as these activities are conducted with a “lawful excuse.” In several locations, Bill C-246 contains phrases like “[e]veryone commits an offence who, wilfully and without lawful excuse…”. For example, possession of a valid hunting or fishing licence would constitute a lawful excuse for killing an animal.
Criminalize any activities involving animals that are protected under aboriginal or treaty rights.

What Bill C-246 WILL do:
· Ban the importation of shark fins into Canada, thereby preventing animal cruelty and the destruction of shark populations and sensitive ecosystems;
· Ban the importation of dog and cat fur into Canada, thereby preventing animal cruelty and the use of furs that the majority of Canadians find distasteful;
· Update the legal definition of bestiality to incorporate acts beyond penetration;
· Facilitate criminal prosecutions in cases of egregious animal cruelty and neglect by updating language from “wilfully causes” or “wilfully neglects” to “wilfully or recklessly” or “negligently” causing something to occur that, without lawful excuse, is prohibited (such as pain, suffering, or injury to an animal) or failing to do something that is required by the law (such as provide adequate care), whereby “negligently” is defined as “departing markedly from the standard of care that a reasonable person would use” Unfortunately, Erskine-Smith said he will remove the new provision “brutally or viciously killing an animal” to appease the animal use groups and the MP’s who support them. Dogs in NB in 2008 were killed when a man used a hammer on them. He was acquitted for five of the dogs he killed because the judge thought that they did not suffer. The current law only applies if the animal actually suffered. He got a 50$ fine for the 6th dog that was injured before it died. The brutally or viciously killing an animal section would have covered that loop hole.

It isn’t only the Western Canadian way of life that they are destroying. Its Canadian life, society, and traditions that they are trying to desperately kill off.

The best way to beat this law, if it comes to be, is very simple: complain about every farm, slaughterhouse, CSPCA, PETA, meat packer, pet owner, fisherman, hunter, herder, falconer, sealer, Inuit hunter, Native hunter, survivalist who hunts for dinner, and whatever and whoever else you can think of. Within the first week of the law, so overload the police and the crown that the law becomes untenable. Show Baby Doc Trudeau what folly his administration is.

Stopping the cruelty of shark finning is admirable. The rest is simply another example of the low information administration we are stuck with for three more years, and our two tine university drop-out PM.

Oh wait, how will Trudeau, aka Prince Dumb, explain this to Muslims when it comes to Eid? I know the sheep and goats would be pleased. No more having head and legs burned while alive before throats are cut.

Some Greeks raise lambs at home and then have a holiday roast. What will Baby Doc Trudeau say to them? Multiculturalism?

I received an email from Erskine-Smiths flunky saying Kosher and Halal slaughter will not be affected by the Bill. Obviously Nate does not see either method to be brutal or vicious.

So we can’t treat our sick livestock with antibiotics (thanks A&W), can’t ship them to market (thanks PETA) and possibly not retire them on the farm.

When the shotgun goes off to end suffering, I doubt any government lackey’s will come running to my farm and charge me.

Hard to find any proof of a “brutal, vicious” death if the coyotes and birds eat the cow in a few days time.

Bills like this are dangerous, not because of their vagueness and ambiguity but because they attempt to blur or erase jurisdictional lines between provincial and federal matters but also between criminal law (federal statute) and misdemeanor regulatory law (provincial).

This bill is a farce and should never get out of first reading because the property and activities it proposes to criminalize in federal criminal code are exclusive jurisdictions of the provinces and municipalities – at least according to section 91/92 of our constitution.

“Domestic Animals” are in law personal chattel property under minor regulation of the provincial agriculture authority and municipal by laws.

Wild animals are crown property and regulated under the wildlife act or resource acts of the province in which they reside. Hunting them is the exclusive regulatory jurisdiction of the provinces.
Animal rights bolshevism has been attempting to undermine provincial jurisdiction of animals under the animal cruelty section of the federal criminal code – they do so by extending and redefining what “cruelty” is. Most of the time Parliamentarians on all sides of the house see these bolshie attempts to mutate criminal, tort and regulatory law for what it is – dangerous meddling in a law system which has stood the test of time.

But the creepy left that now has infiltrated the Liberal party are unsympathetic to Canadians, our law and our cohesion- they have AGENDAS and these agendas are diametrically opposed to our constitutional rule of law.

That is why seemingly insane bills like this should have us reminding our MPs en masse that we will stand for no meddling in constitutional boundaries between individuals and chattel property use or jurisdictional protections of this. The last time they transgressed jurisdictional boundaries in regulating chattel property we got the Liberal gun registry law – and we’ve all seen what a horrendous abomination of criminal law that has been.

I believe all animals should be killed as humanly as possible. I also believe that the animals, better known as Mulims, should be forced to slaughter their animals in a humane manner, unlike their normal method of a small cut in the Jugular to allow the animal to bleed out as slowly as possible. I posted a couple of weeks ago how hunting may go by the wayside with the stupid lefty agenda. Both federally and here in Alberta with the Gang of Rachael, they will eventually try to eliminate hunting. They are truly sick.

There appears to be no religious exemptions in the legislation, therefore, it should be challenged immediately under its definition of “brutally or viciously” by pressing charges against someone committing Halal slaughter.
If Halal is ruled NOT to be brutal, how can almost any other form of animal killing be deemed cruel?
Our Dear Leader will NOT allow Halal slaughter to be called brutal, therefore, this bill will basically be rendered irrelevant to hunters and fishers.
